END USER SOFTWARE LICENSE AGREEMENT
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS DO NOT INSTALL THE SOFTWARE. BY CLICKING 'I ACCEPT', 'OK', 'CONTINUE', 'YES', 'NEXT' OR BY INSTALLING OR USING THE SOFTWARE IN ANY WAY, YOU ARE INDICATING YOUR COMPLETE UNDERSTANDING AND ACCEPTANCE OF THE TERMS OF THIS AGREEMENT.

This License Agreement is a legal agreement between you (either an individual or a single entity end user) and Bits SRL ('Bits') for use of Bits's product, which includes computer software and may include associated media, printed materials, and 'online' or electronic documentation ('Software'), all of which are protected by Romanian and international copyright laws and international treaty protection. By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, do not install or use the Software.

The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold.

The Software is SHAREWARE. You may install this program to test and evaluate for 30 days. Following this test period if you wish to continue to use the Software you MUST either register this program or remove it from your computer hard drive and other storage devices.

Once registered, the user is granted a non-exclusive license to use the Software on one computer. The Software may not be rented, but may be permanently transferred, if the person receiving it agrees to the terms of this license.

You may reproduce and distribute an unlimited number of copies of the SHAREWARE version of the Software, provided that each copy shall be an identical one (including all copyright and trademark notices, and accompanied by a copy of this “End User Software License Agreement”).

You may not alter this software in any way; you may not use or distribute any part of the original package. Also you are not allowed to emulate, decompile, disassemble, and otherwise reverse engineer any part of the original package. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

THE SOFTWARE IS DISTRIBUTED ON THE 'AS IS' BASIS. NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED.

Anyone using, testing, or evaluating the Software bears all risk. In no event shall Bits be liable for any damages of any kind, including, without limitation, direct or indirect damages arising out of the use, performance, or delivery of the Software, even if Bits has been advised of the existence or possibility of such damages. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO CASE SHALL BITS'S LIABILITY EXCEED THE PURCHASE PRICE PAID BY YOU FOR THE SOFTWARE. The disclaimers and limitations set forth above will apply regardless of whether you accept or use, evaluate, or test the Software.

This Agreement will be governed by the laws of Romania and by the international copyright regulations and treaties. Any dispute will be settled in courts from Craiova, Romania. This Agreement may only be modified by a license addendum, which accompanies this Agreement or by a written document which has been signed, by both you and Bits This Agreement has been written in the English language only and is not to be translated or interpreted in any other language. Prices, costs and fees for use of the Software are subject to change without prior notice to you. In the event of invalidity of any provision of this Agreement, the invalidity shall not affect the validity of the remaining portions of this Agreement. The Software and the Software logos are trademarks of Bits All other trademarks are the property of their respective owners.
